TERMS OF CONDITIONS

All Back on Track (N.I.) Ltd’s Customers as defined by this Agreement below (“Customers”),  and those ocasionally visiting Back on Track N.I. Ltd must comply with the following Terms and Conditions.  These Terms and Conditions are incorporated into every agreement for the provision of  fitness or treatment services entered into between you and Back on Track N.I. Ltd.  Any person who does not comply with these terms and conditions may be ejected from, or denied access to the Back on Track N.I. Ltd Facilities and/or any of the services provided therein, or may have their contractual or other financial agreement terminated at the sole discretion of the Directors of Back on Track (N.I.) Ltd, in the event that the non-compliance is repeated or serious. We reserve the right to make reasonable amendments to these Terms and Conditions, at any time.  If we do this, we will give Customers reasonable notice in advance. 

DEFINITION OF TERMS

Agents:  All persons specifically authorised by the Directors of Back on Track N.I. Ltd.

Fitness Services: Including but not limited to, the provision of personal training sessions (individual and class sessions), TRX classes, pilates classes, pre- and post-natal pilates classes.

Treatment Services: Including but not limited to the work of our physiotherapists and dietitians and all treatments that fall under the scope of the individual therapist as defined by their governing body and the HCPC.

Guests: Including but not limited to any person or persons accompanying a Customer, all persons attending for the purposes of observation, whether at the invitation of Back on Track N.I. Ltd or its Customers.

Independent contractors: All personal trainers and therapists engaged by the Directors of Back on Track N.I Ltd, providers of fitness and treatment services and external service providers.

Customers: Those individuals and groups participating in physiotherapy sessions (including all appointments booked through external organisations or intermediaries), dietitian sessions, personal training sessions (individual or class), TRX classes and pilates classes, and TRX and pilates 1:1 sessions(including all classes booked through external organisations or intermediaries)

CUSTOMER RESPONSIBILITIES

Acceptance and provision of all fitness and treatment services is at our absolute discretion (although we will exercise our discretion reasonably, and in compliance with applicable laws).

Provision of all fitness and treatment services is upon the condition that the Customer has completed and submitted their Patient Profile document and relevant Health Questionnaire, and confirmed that they have read, understood and accepted these Terms and Conditions.  We reserve the right to refuse or withdraw provision of fitness and treatment services to any Customer who has failed to complete and submit the Patient Profile document and relevant Health Questionnaire and these Terms and Conditions.

It is the sole responsibility of each Customer to draw to our specific attention and keep us fully informed in advance of and during each fitness or treatment session, the following:

  • Any serious or other health conditions (including medications) which do impact or are at risk of impacting their physical fitness, well-being and ability to participate in fitness and/or treatment sessions.

  • Any change, deterioration or progression of any health condition that does impact or is at risk of impacting their physical fitness, well-being and ability to participate in fitness and/or treatment sessions. 

  • Any medication which they are currently taking and the side effects thereof. 

  • Any medical or other professional advice they have received in respect of their participation in fitness or treatment activities. 

  • During the course of any fitness or treatment session, any pain or other physical effects that place their physical well-being at risk.

 

No Customer will participate in any fitness or treatment activity unless they are fit and able to do so without risk of injury and without endangering their health and safety.  Every Customer undertakes to fully comply with any medical or professional advice or recommendations in respect of the performance of fitness or treatment sessions, irrespective of whether they have drawn the same to our attention.  Any customers unsure of their health status, who have health concerns or who do not participate in regular exercise must consult their doctor before participating in any fitness or treatment activity. By participating, the customer is declaring they are fit to do so. Customers accept that fitness classes at Back on Track may be strenuous and voluntarily participate, with full knowledge of potential injury or death. There exists the possibility of certain dangers including but not limited to abnormal blood pressure, fracture, fainting, irregular fast or slow heart rhythm, and in rare instances heart attack, stroke or death. It is vital that customers stop exercising and inform the instructor if you they feel unwell. Customers realise that they may stop when they wish because of feelings of fatigue or any other discomfort.

Although every effort is made to ensure the equipment is functioning correctly and used in the correct manner, using the equipment in the class has the potential to cause injury.

Any items or personal belongings brought by Customers and retained in Back on Track (N.I.) Ltd’s Facilities for any duration is entirely at the Customer’s own risk.  We do not accept any liability for personal belongings.  Customers must not take any pictures, or videos (whether by use of a camera, mobile phone or other device), or post the same on any social media or public outlet, of any other Customer or Guest of Back on Track (N.I.) Ltd without the Customer or Guest’s express knowledge and consent.  We reserve the right to remove any persons acting on violation of this term and terminate the provision of all fitness or treatment services to that person immediately.  At all times, each Customer should conduct themselves in a manner that will not disturb or impair the use and enjoyment of Back on Track (N.I.) Ltd facilities by any other person.  In particular, Customers may not use foul, loud, or abusive language, nor will they behave in a threatening manner; molest, or harass, other Customers, Guests, Visitors, or the Directors of Back on Track (N.I.) Ltd, their agents or Independent Contractors. Customers may not bring, use, or be under the influence of illegal drugs in back on Track (N.I.) Ltd facilities and may not bring any alcoholic substance.  Customers must ensure that footwear must be appropriate.

GUEST AND VISITORS

Customers (over the age of 18) may bring Guests to Back on Track (N.I.) Ltd at our sole discretion.  Customers must accompany their Guest at all times, and the Customer who brings the Guest remains responsible for their Guest’s conduct, health, safety and well-being whilst they are in facilities of Back on track (N.I.) Ltd.  The Customer must not leave before their Guest.  It is the responsibility of each Customer to ensure that at all times: The Guest complies with the Terms and Conditions of Back on track (N.I.) Ltd.  The Guest does not act in any manner that causes or is at risk of causing harm to themselves or to other visitors and users of the facilities. The Guest does not use any of the equipment in Back on Track (N.I.) Ltd’s facilities without the express authorisation of the Directors of Back on Track (N.I.) Ltd, their agents or Independent Contractors, and only in the express manner prescribed or instructed, and only for the purposes for which such use is authorised.  The Guest does not interfere with or obstruct the provision of services or the enjoyment of such services by Customers.  The Guest does not interfere with, damage or otherwise handle, any personal belongings of the Directors of Back on Track (N.I.) Ltd, their Independent Contractors or Agents, Customers or their Guests.  The Guest must not take any pictures, or videos (whether by use of a camera, mobile phone or other device), or post the same on any social media or public outlet, of any other Customer or Guest of Back on Track (N.I.) Ltd without the Customer or Guest’s express knowledge and consent.  The Guest does not use foul, loud, or abusive language, nor will they behave in a threatening manner; molest, or harass, other Customers, Guests, Visitors, or the Back on Track (N.I.) Ltd’s Directors, their Agents or Independent Contractors.  The Guest may not bring, use, or be under the influence of illegal drugs in back on Track (N.I.) Ltd facilities and may not bring any alcoholic substance.  We reserve the right to eject any Guest from the facilities who does not comply with these Terms and Conditions or who otherwise compromises, through their verbal or physical conduct, the health, safety, welfare, service provision or enjoyment of services, of our Trainers, Service Providers, Customers and Guests.  Customers may not bring pets (excluding Guide Dogs).

You should seek instruction before using unfamiliar equipment.  Each Customer undertakes that they will not use any of the fitness equipment in Back on Track (N.I.) Ltd’s facilities without the express authorisation of the Directors of Back on Track (N.I.) Ltd, their Agents or Independent Contractors, and only in the express manner prescribed or instructed and only for the purposes for which such use is authorised.  You are asked to arrive five minutes prior to any fitness, treatment or induction appointments.  We reserve the right to refuse to re-book an appointment for you if you repeatedly cancel (with less than 24 hours notice) or fail to keep an appointment for services or treatments.  You may not use the gym space of Back on Track (N.I.) Ltd for exercise purposes while under the influence of alcohol, anticoagulants, antihistamines, beta-blockers, narcotics, tranquilisers or any medication or other substance if any of these affect your ability to exercise safely.  It is your responsibility to find out and be aware of the side effects of any medication and their effect on your ability to exercise, and to draw these to our attention.

GYM SPACE USE

Physiotherapy/Dietitian/BikeFit/Massage

Any appointments cancelled 3 hours or more before the appointment time will incur no charge.

Any appointments cancelled within 3 hours of the appointment time, or in the event of you not arriving for an appointment, will incur a charge equal to the full cost of the appointment type.  This amount will be taken from your credit/debit card that you have registered with us when creating your Patient Profile and by agreeing to this waiver, you give us permission to charge this card without request, if you are in breach of this Cancellation Policy.  If the appointment is part of a membership or bundle of treatments, the cancelled or missed appointment will be deducted from the remaining appointments of the bundle or membership on your account.

Myofascial Appointments

Any appointments cancelled more than 24 hours before the appointment time will incur no charge. Appointments cancelled between 2 and 24 hours prior to the appointment time will incur a charge of £40 for a 60min appointment, £30 for a 45min appointment and £20 for a 30min appointment. Any appointments cancelled within 2 hours of the appointment time, or in the event of you not arriving for an appointment, will incur a charge equal to the full cost of the appointment type.  These amounts will be taken from your credit/debit card that you have registered with us when creating your Patient Profile and by agreeing to this waiver, you give us permission to charge this card without request, if you are in breach of this Cancellation Policy

Pilates/TRX Classes and 1:1 sessions

Any bookings for classes or 1:1 sessions cancelled within 12 hours of the appointment time, or in the event of you not arriving for a class or 1:1, will incur a charge equal to the full cost of the class or 1:1 type.  This amount will be taken from your credit/debit card that you have registered with us when creating your Patient Profile and by agreeing to this waiver, you give us permission to charge this card without request, if you are in breach of this Cancellation Policy.  If the class or 1:1 session is part of a bundle of classes or 1:1 sessions, the cancelled or missed class or 1:1 will be deducted from the remaining classes or 1:1 sessions on your account.

CANCELATION POLICY

Customers and Guests must use the main entrance to the Clinics when entering or leaving.  Fire exits, which are clearly marked, are there in the interests of safety and Customers and Guests must not interfere with fire doors for any reason.  Customers and Guests must read any health and safety notices posted outside on or near any equipment or facility rooms within the clinic and comply with their recommendations.  Customers and Guests must comply with any reasonable requests made by Back on Track (N.I.) Ltd, its Agents or Independent Contractors in relation to matters of health and safety.

HEALTH AND SAFETY

Any client using a Health Insurance Policy to cover costs of assessment and treatment must have an Authorisation Code with details on the number of appointments authorised, before treatment commences.  In the event that you arrive for an appointment without an Authorisation Code, assessment and/or treatment must be paid for privately or postponed to such a time where you are able to produce your Authorisation Code.

HEALTH INSURANCE CLIENTS

CHILDREN

Child Customers, under the age of 16, must be under direct adult supervision at all times.  Child Customers or guests may only be brought into the clinics if accompanied by their parent, legal guardian, or any other person who is authorised to and does take responsibility for them.  For the avoidance of doubt, Back on Track (N.I.) Ltd does not act in loco parentis in respect of any Child Customer or Guest at any time. 

Back on Track (N.I.) Ltd shall not be liable for any personal injury, loss or damage suffered by any Customer or Guest unless and to the extent that the same is caused or materially contributed to by the negligence, breach of statutory duty, unlawful omission or unlawful default of Back on Track (N.I.) Ltd or its expressly authorised Agents.  For the avoidance of doubt, Back on Track (N.I.) Ltd is not liable for any personal injury, loss or damage suffered by any Customer or Guest to the extent that the same is caused or materially contributed to by the negligence, breach of statutory duty, omission or default of its independent contractors, their employees or agents.  Back on Track (N.I.) Ltd is not liable for any personal injury, loss or damage suffered by any Customer or Guest caused or materially contributed to by the negligence, breach of statutory duty, omission or default, of these Terms and conditions or otherwise, of its Customers and Guests.

LIMITATION OF LIABILITY

The terms of this agreement and enforcement thereof shall be governed by the law and courts of Northern Ireland

In agreeing to this release of liability and terms and conditions, I (the customer) declare that I have read and understood the information set out in these terms and agree to comply. I agree that neither I, my heirs, assigns of legal representatives will sue or make any other claims of any kind against Back on Track Pilates/ Back on Track NI Ltd or its members for any personal injury or wrongful death, whether caused by negligence or otherwise.

JURISDICTION
